Description

This course will introduce students to the law of personal data in the U.S., the EU. This seminar presents a three-part story: part one will introduce the student to the fundamental concepts of U.S. and European, privacy; part two will identify how differences in those frameworks have created legal and policy conflicts challenging cross-border flows of data with particular emphasis on the intersection of national security and privacy concerns in the trans-Atlantic space; and part three will identify how those conflicts have been addressed through negotiations, practice, and legal instruments. Students will become familiar with major privacy arrangements including the U.S.-U.K. Cloud Agreement, the EU-U.S. Umbrella Agreement, and the now-invalidated EU-U.S. Privacy Shield Framework.
