This class is an online course this year. Half of the course will be asynchronous (I’ll have a series of lectures that you can watch at your own pace) and half of the course synchronous (meeting together on zoom at scheduled times). After you watch the asynchronous parts, we will meet, discuss the materials, go over some problems/hypos, and repeat. Our first meeting will be on Zoom from 5:00-7:00 starting on June 13; then you have additional readings and videos to complete before we meet for the next class and so on. It sounds complicated, but it is all spelled out in the syllabus below.

Description

This course will serve as an introduction to the basics of patent litigation and practice, with an emphasis on pre-trial practice. It will cover aspects of litigating before U.S. Federal Courts, the U.S. International Trade Commission, as well as post- grant review proceedings before the U.S. Patent & Trademark Office. Through classroom discussion, written assignments, and mock exercises, students will explore a range of topics including pre-litigation considerations, pleadings, PTO strategies, claim construction proceedings, technical fact and expert depositions, motions practice, and trial. This course will be an ideal springboard for a further study of patent law, both during the summer and during the school year. No previous patent experience is required.

Cases and articles will be available on the course canvas page. This will serve as the bulk of the materials for this course. In addition, we will also reference MOORE, ET AL., PATENT LITIGATION AND STRATEGY (5th Edition). Due to the book’s price tag, however, it is only a recommended read. You can get with only the materials I provide. All videos are available on the course’s canvas page.
