This class will survey the evolution of intellectual property chapters in Free Trade Agreements. The class will study the provisions and politics of intellectual property in trade forums from the Pre-TRIPS period (Special 301 and NAFTA) through TRIPS, the post-TRIPS bilateral FTAs and, finally, two recent “plurilateral” trade agreements – the Anti-Counterfeiting Trade Agreement and the Trans-Pacific Partnership Agreement (TPP). Special attention will be paid to the politics and economics in two major areas – pharmaceuticals and enforcement of copyright in the digital environment. The class will feature guest lectures by experts and advocates. Evaluation will be by means of a short essay take home examination.
