Description

This is a new survey course and seminar designed to analyze the overall structure, purpose, and tripartite operation of the International Labor Organization [ILO] and its influence on the design and implementation of international labor law. The ILO from its inception at the Treaty of Versailles to its role today as an advocate for fair globalization will be presented through legal review and analysis of these primary source documents: ILO Constitution, UN Human Rights documents and economic/employment rights policy decisions, various ILO Conventions and interpretive guidelines, and ILO reports. Major regional legal systems and their incorporation of ILO Conventions and Declarations into both domestic legal systems as well as regional trade agreements will also be reviewed.

The course begins by reviewing the ILO Constitution and its policy making procedures including the Declaration of Fundamental Principles and Rights at Work. The structural components of the ILO including its Governing Body as well as its various working Committees will be presented. Specific focus will be presented on the role and function of the Freedom of Association[FOA] Committee investigation and hearing process. Case Study Materials used on this course will focus on the ILO 96th Session [2007] and 97th Session [2008] International Labor Conferences. Case Study materials in the last part of this course will include an analysis of theses five ILO focus areas for country-specific global development partnerships: The Global Campaign for Decent Work; Employment Migration and Domestic Market “ Brain Drain”; Women and Work ;Child Labor and Occupational Health and Safety.

This course will include assigned readings; weekly lectures, video presentations, guest speakers, small group case study presentations and a seminar paper in lieu of a final exam.
