Description

This seminar will be taught by James Toupin, a former General Counsel at the US Patent and Trademark Office. The course is structured as a research seminar. It is not a substitute for an administrative law survey course, which students are encouraged to take before or concurrently with this seminar. The course will focus on the laws governing the structures and processes of the agencies involved in administering federal patent and trademark law. We will chiefly address the authorities of the US Patent and Trademark Office, but also the intellectual property enforcement mechanism administered by the US International Trade Commission. Grading will be based on class participation in discussions of reading assignments as well as on a research paper that each student will present to the class.
