Description

This course aims to compare the main western traditions of tort law. The course will start with introducing the French law of torts to illustrate a continental way of approaching law in general, and tort law in particular. You will learn not only why French law is quite different from the common law, but also from other continental tort law traditions, mainly Italian and German law, which are, on the contrary, quite similar to common law. Next, you will examine these different tort law traditions by addressing "harmonization" efforts at a European level.

This course not only focuses on the technical aspects of tort law, but it also reveals an anthropological dimension of law and the evolution of the society at large.
