Description
This two-credit advanced antitrust course and associated one-credit practicum will study legal and economic issues that arise in horizontal merger analysis under the antitrust laws, during enforcement agency review and litigation, along with advocacy issues that arise in litigating merger challenges in federal court. One aim of the course is to prepare you to join a team investigating (for the government) or advocating (for the firms) a proposed merger and contribute immediately.
The class will combine classroom discussions of topics in the antitrust analysis of horizontal mergers with multi-class simulation exercises to apply that learning. The simulation exercises will be based upon the pleadings and testimony in a recent Justice Department challenge to a proposed consolidation involving two of the three leading U.S. manufacturers of kitchen ranges.
You must register for both the course (Law-693), taught by Prof. Baker, and the Practicum (Law-693A), taught by Prof. Mosier. Students not previously or concurrently enrolled in Antitrust Law may register with permission of the instructors. Class will meet Mondays and Wednesdays, from 6 pm to 7:30 pm. All 90 minute class sessions will be co-taught by the two instructors. This course will satisfy the law school’s professional skills requirement.
