Description

The course will explore the legal regimes – contract, national law, international law, and treaty-based – that govern international or cross-border investment. It will discuss both the mechanisms that private parties, national governments, and international organizations put in place to encourage and protect international investment (such as contractual guarantees, risk insurance, and bilateral or multilateral investment treaties), as well as the mechanisms that are put into place to regulate or otherwise shape such investment (such as laws and regulations or soft law instruments on issues such as sustainable investment or anti-corruption).

There will be some overlap with Investment Treaty Arbitration because investment treaties will be one of the topics covered, but the focus will be on law and policy of investment treaties rather than exclusively on the disputes themselves.

The course will include a practical, issue-spotting simulation exercise.

Exam: Research paper (15 pages) and heavy emphasis (at least 30%) on class participation.

This course is one of the pre-requisites for the fall course Advanced research seminar on international investment and commercial law (Law-679a-001) taught by Professor Susan Franck.
