Description

Real property financing has recently been a hot button topic, but it has long been a main-stay of the general practice of law and of the bar exam, in both its essay and multi-state portions. Your attention in Property during your first year of law school was directed at a few of the problems in the transfer of title to real property -- delivery of deeds, the recording acts, etc. This course expands that presentation to a discussion of the services and documents that lead to the financing of real property -- brokerage services, con¬tracts of sale, escrow agreements, title insurance, and (in great detail and most helpful to you on the bar exam) mortgages. Think of it as a course in secured transactions for real estate. It has 2 components: mortgages and investments. Like any transactions course, it is a blend of tort, contract, property, insurance, tax, and business association law.
