This course aims to give students a basic understanding of the structure of U.S. labor and employment law. Its focus is on the various ways in which law regulates the employment relationship. It seeks to advance two key goals: first, to prepare you to spot and evaluate some of the major employment and labor law problems a client (whether employee or employer) would be likely to face today; and, second, to give you an appreciation of the comparative benefits and drawbacks of the multitude of approaches to regulating the employment relationship currently existing under U.S. law. To this end, the course begins with an examination of several main approaches to regulation of the employment relationship. Some of these approaches involve the protection of individual employee rights. This is the area generally referred to as employment law. Another approach applies to unionized workplaces in the U.S. This approach sets the ground rules for employees’ collective determination, in negotiations with their employer, of some of the terms and conditions that will govern their employment arrangements. This second approach is known as collective bargaining, and the law associated with it is generally referred to as labor law. We will examine selected legal topics that arise within both of these regulatory paradigms, and we will compare the strengths and weaknesses of these different regulatory approaches.
