Description

The rules governing the conduct of states inter se and their relations with individuals and legal entities; jurisdictional concepts; the status, application, and litigation of international law rules in U.S. courts; sovereign's immunity; recognition; international agreements; the Law of the Sea; human rights; and international claims and adjudications.

Aug. 25 2. International Law in Action Read handout (excerpts from internal Bush Administration legal memoranda concerning the treatment of detainees captured in Afghanistan; various relevant or related legal texts), and the following instruments in the Doc. Supp.: Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (beginning on p. 472 of Doc. Supp.); Geneva Convention Relative to the Treatment of Prisoners of War (beginning on p. 983 of Doc. Supp.), especially Articles 4, 129 and 130; Vienna Convention on the Law of Treaties (beginning on p. 49 of Doc. Supp.), Articles 1, 2, 6, 19, 21, 26, 27, 31 and 32. Please note that some portions of the handout assigned for August 25 will be re-assigned for class on September 8.
