Description

This course will provide students with an introduction to the law, policy and institutions of the European Union (EU). The EU is an unprecedented experiment in economic and political integration, and EU law has played a central role in creating a quasi-federal polity based on the Treaty of Lisbon and its interpretation by the Court of Justice of the EU (CJEU). The course will provide students with an understanding of the structure and operation of the EU and its legal system and will introduce them to a number of salient legal and policy issues facing the EU in comparison to the US. The course begins by examining the development of EU institutions and the fundamental principles of EU law, including direct effect, supremacy and fundamental rights, as well as four freedoms, competition and privacy law essential for the operation of the internal market. Second, we will cover the Union’s common commercial policy (CCP) including trade, investment and development treaties and common foreign and security policy (CFSP) that shape the EU foreign relations laws. Finally, we will examine the legal and policy tensions surrounding four intersecting crises that have confronted the EU in recent years: Brexit, the refugee debacle, and the democratic backsliding in Hungary and Poland and the shortcoming and opportunities of the COVID-19 pandemic.
