Description
This course analyzes the U.S. and international legal regimes for regulating international trade in goods, services and intellectual property. The course begins with a brief introduction to international trade theory. It then examines the U.S. constitutional aspects of international economic relations and the legal structure of the World Trade Organization (WTO) and the General Agreement on Tariffs and Trade (GATT). It next analyzes specific aspects of international trade regulation, including tariffs, quotas, and non tariff barriers; the most-favored-nation obligation; free trade areas and customs unions; the national treatment obligation; trade and environmental policies; escape clauses, safeguards, and adjustment policies; dumping; subsidies and countervailing duties.
The objective of the course is to provide an in depth understanding of the following: (1) perspectives on international trade agreements from 1947 to the present and the post WWII international economic order; (2) non-discrimination and market access principles in international trade agreements; (3) provisions of the WTO Charter and its annexes with particular emphasis on GATT 1994 and the WTO Annex 1A agreements; (4) dispute settlement mechanism of the WTO and selected case law; (5) relationship of the multilateral system with the regional trading arrangements such as the TPP; and (6) contingent trade measures (safeguard, anti-dumping, and countervailing duty remedies).
