Description

Public Law & the Regulatory Process: The Regulation of Health & Environmental Risks

Our industrial economy creates enormous benefits but also poses significant public health and environmental risks. This course will briefly introduce you to some of those risks, explore the limits on addressing the risks through the market, and discuss the theoretical justifications for regulation. We will also consider the challenges of risk regulation, including designing regulatory institutions that accomplish their work efficiently and well; choosing among different kinds of regulatory instruments; prioritizing risks; assessing the costs and benefits of regulation; and assuring that regulatory institutions remain accountable to the public that they serve. We will look at the theoretical justifications for and limitations of the regulatory state in the context of public health and environmental risk, rather than focusing on any particular risk or regulatory agency. Accordingly, this course will be useful for students interested in such areas as environmental law, occupational safety and health law, public health law, and food and drug law. (E)
