Description

This is a survey course on the law of health care delivery and financing in the United States with a focus on law and policy tools for improving the quality of and access to health care while controlling costs. The course is designed as a gateway to more specialized health law course offerings for students interested in pursuing extensive health law study. Topics include: informed consent; end of life decisions; civil liability of health care providers and managed care organizations; regulatory and market-based approaches to improving the quality of health care delivery; licensing, disciplinary action, and scope of practice; legal obligations of physicians and hospitals to provide care regardless of ability to pay; state and federal regulation of private health plans; Medicare and Medicaid eligibility, coverage, administration, payment, and appeals; and tax incentives for the purchase of private health insurance. This course does not cover the law of health information privacy or health care fraud and abuse. These very important topics are covered in other WCL courses, which any student interested in practicing health care law should take.

The required casebook is FURROW, ET AL., HEALTH LAW: CASES, MATERIALS AND PROBLEMS (7th ed. 2013). I will supplement this text with additional reading assignments, which will be provided via MyWCL. I also recommend (but do not require) JONAS, ET AL., AN INTRODUCTION TO THE U.S. HEALTH CARE SYSTEM (7th ed. 2012) for an overview of the U.S. health care system.
