Description

Overview: This course addresses the rules applicable in private law where at least one of the operative facts in the case is connected with some state or country other than the one in which the suit is brought. The areas examined include: torts, contracts, property, commercial law, administration of estates, and family law. The course also considers the recognition and enforcement of judgments of sister states and foreign countries. Generally, we will look at some fascinating intellectual puzzles that state and federal courts -- and attorneys -- confront on a daily basis. This is an essential course for students pursuing a career in civil law, as opposed to criminal law.

There are two books required for this course:

  • Casebook: Currie, Kay, Kramer & Roosevelt, Conflict of Laws: Cases, Comments, Questions (West, 8th ed. 2010) (will be available in the campus bookstore, but you should feel free to purchase it elsewhere: ISBN: 978-0-314-19581-4).

    NOTE: The 9th edition came out in 2013. ***DO NOT BUY IT.*** The 8th edition is better! Please use the ISBN I have provided.

  • Supplement: Robbins, Conflict of Laws - 2016 Supplement [You may purchase the Supplement in hardcopy in Room YT07 or access the pdf version for free on our MyWCL web site. The Supplement will be available as a free download on our MyWCL web site -- under Course Materials -- the week before classes begin].
