Description

An overview of key concepts in cross-border disputes, including choice of law, recognition and enforcement of judgments, and constitutional doctrines such as Full Faith and Credit. This course provides an unique opportunity to review personal jurisdiction, as well as the infamous "Erie Doctrine." Following a survey of traditional and modern theories of choice of law, we will examine cutting edge multi-jurisdictional issues, such as recognition or bars to same sex marriages and current international problems, including internet defamation.

First Class Readings

For Thursday, August 25, the class time will be broken into three sections of materials:
Section 1: Pages 2-17 in Currie, Kay and Kramer's Conflict of Laws (6th Edition)
Section 2: Pages 17-38
Section 3: Pages 38-47

In addition, please try to see at least the first half of Steven Spielberg's movie Amistad (available at Blockbuster and similar rental locations) prior to today's class. We will use excerpts from this movie in class to discuss "choice of law." As you watch the opening courtroom scene, where the judge is meeting the parties and the claimants for the first time, ask yourself how you would "characterize" the choice of law issues presented for the judge to decide. "Characterization" is a key choice of law concept.
