Description

This is the required constitutional criminal procedure course, covering such topics as Fourth Amendment search and seizure law, the law of confessions from the Fifth, Sixth, and Fourteenth Amendments, and identification procedure law under the Sixth and Fourteenth Amendments. Topics covered include: what is a “search”; what is a “seizure”; when a warrant is required; the concept of probable cause; the stop and frisk doctrine; exceptions to the warrant requirement; the exclusionary rule and its good faith exception; the Miranda doctrine; voluntariness of confessions; the right to counsel; and identification procedures. The course methodology includes the use of problems and each class (except the first class) has a problem associated with it. Each student is required to argue for the prosecution or the defense on one of the problems during the course of the semester, and all students in the class are expected to be familiar with each problem.
