Description

The Criminal Procedure I course generally focuses on pretrial criminal procedure and constitutional limitations on government power to ferret out and suppress crime. The course also addresses how constitutional doctrine tries to protect against, or remedy, government overreaching and unacceptably invasive or abusive practices. Topics we will cover include search and seizure law, technology-enhanced surveillance, interception of electronic data, stop and frisks, traffic stops, profiling, arrests, the exclusionary rule, police interrogation, the right to counsel and plea bargaining—which is how more than 90 percent of criminal cases are actually decided and terminated.
