Description

Criminal Procedure I: Investigation addresses constitutional issues arising under the Fourth, Fifth, and Sixth Amendments. The vast majority of the course will address substantive and remedial Fourth Amendment issues concerning searches and seizures and substantive and remedial Fifth Amendment issues concerning interrogation of suspects by law enforcement officers. We will also cover certain right-to-counsel issues under the Sixth Amendment, including the admissibility of uncounseled confessions and uncounseled pretrial line-ups, as well as the right to the effective assistance of counsel.

First Class Readings

For the first class, please skim pages 1-30 and read pages 31-59 in our casebook. Although you may normally skip concurring and dissenting opinions in this course, please do read Justice Harlan’s concurring opinion in Katz (on pp. 36-37) and Justices Sotomayor and Alito’s concurring opinions in Jones (on pp. 42-48). Also, please read the Supreme Court’s syllabi (the official case summaries) in Carpenter v. United States, 138 S. Ct. 2206 (2018), and Bond v. United States, 529 U.S. 334 (2000).

Also, please add this to the section on the casebook required for this class: E. Chemerinsky & L. Levenson, Criminal Procedure: Investigation (Aspen 2018, third edition) (paperback). There is no need to buy the 2019 supplement. The instructor will provide you with supplemental cases.
