Description

This course focuses on criminal procedure, with a particular attention to the Fourth, Fifth, Sixth and Fourteenth amendments to the U.S. Constitution. We will address an exciting and provocative set of issues dealing with fundamental questions about government power, individual liberty, and the appropriate balance between the two. Specifically, we will examine the constitutional rules and standards dealing with the investigation of crime, and, in so doing, consider how effectively these rules and standards protect the sometimes competing values of liberty, crime-control, justice and equality.

Students also will have the opportunity to attend a moot argument in a criminal procedure case scheduled for U.S. Supreme Court this term, participate in a police ride-along, and/or attend an arraignment or motion hearing in D.C. Superior Court. Details will be provided separately.
