First Class Readings

Please read pages 1-31 of the casebook, A. Benjamin Spencer, Civil Procedure: A Contemporary Approach (4th rev. ed. 2015). When you purchase your book, please ensure that you are buying the correct revised version of the book published in 2015.

NB: If you are frustrated or confused by Pennoyer v. Neff, welcome to the club. It is not an easy case and, in many respects, reading it is a rite of passage in becoming a lawyer in the United States. While the case has limited ongoing authority, it nevertheless makes important points about litigation and provides an opportunity to think about the lifecycle of disputes. It also offers a historical context about where U.S. Civil Procedure has been, so that you can consider where it should go in the future. Please have some patience as you review the case and know that, when we discuss it in class, I hope it will make more sense and will help paint a broader picture for understanding dispute settlement.
