       The following definitions apply under this article:

       (a) Statement. [Changes highlighted] A "statement" [(1) is an oral or written assertion or any (2) nonverbal conduct or expression of a person if it intended by that person as an assertion] is all speech or writing, as well as any action that communicates a message.
