Communication 1875 (Chile)
1875. This case includes a list of 25 cases of individuals who are allegedly being tried under Court Martials in Chile. Classification of this case was handled on the basis of the criterion established by the Commission during its thirty-third session.
In a note of October 11, 1974, the Commission requested the Government to provide the appropriate information. A copy of that note and the appendix was sent to the Chilean Delegation to the OAS on October 30, 1974.
As in the previous case at its thirty-fifth session (May 1975) the Commission noted that the Government of Chile had not replied to the request for information, and that the period of time provided for under Article 51 of the Regulations for transmittal of the information had elapsed. It therefore decided in application of Article 51, to presume confirmation of the matters contained in this file, if by September 30, 1975, the Government of Chile had not provided that information.
During its thirty-sixth session (October 1975) the Commission studied the status of the case, noting that the Government of Chile had still not provided the information requested through the note sent on October 11, 1974. However in order, to provide that Government more time to transmit that information, it decided to reconsider the decision adopted at the thirty-fifth session, turning the matter over to the working group appointed to study certain special cases, to study this file in order to formulate the recommendation as to processing thereof.
