Communication 1865 (Chile)
1865, of July 27, 1974, denounces the arbitrary arrest of Mrs. Lastenia Herrera González, 67 years of age, and the mother of a former Ambassador of Chile to the OAS.
In a note dated August 2, 1974, the Commission requested the Government of Chile to provide the appropriate information.
Through a letter dated October 23, 1974 (No 18109) the Government of Chile replied that the individual in question had been arrested by virtue of the provisions on "State of Siege" and that her residence had been searched by order of the competent authority.
The Commission examined this case during its thirty-fifth session (May 1975), together with information provided by the Government of Chile. It decided to request that Government to kindly report whether it intends to release the detainee in the near future or, if there were charges, to bring her to trial.
Pursuant to this decision, a note was sent to the Government of Chile on August 6, 1975. The claimant was informed of this measure on that same date.
In a note of October 2, 1975 (No 18378), the Government of Chile replied to the request filed on August 6 by reporting that Mrs. Herrera González is free, as stated in Exempt Decree No 136 of November 21, 1974.
At its thirty-sixth session (October 1975) the Commission, after taking cognizance of the information provided by the Government of Chile, decided to file this case.
The Government of Chile was informed of this decision through a note dated December, 1975.
