Communication 1842 (Uruguay)

1842, of June 27, 1974, denounces the arbitrary arrest of Dr. Francisco W. Pucci, in Montevideo, on May 25, 1974. Dr. Pucci is the current Chairman of the Uruguayan Odontological Association and Chairman of the Council of the International Federation of Dentists for Latin America.

In a cable dated July 10, 1974, the Commission requested the Government of Uruguay to provide the appropriate information.

In a note dated September 9, 1974 (N1 341/74-16.B.18), transmitted through its Mission to the OAS, the Government of Uruguay replied to the request filed by the Commission by stating that Dr. Pucci had been arrested on May 25, 1974 for "ties with subversive activities", and was being held under the control of the Executive Power in accordance with the Prompt Security Measures adopted in accordance with the Constitution (Article 168, paragraph 17).

The Commission examined the case during its thirty-fourth session together with this information and approved a resolution (doc.24-34) the text of which was transmitted to the Government of Uruguay on December 17, 1974. The claimant was also informed of this resolution through a letter dated November 7, 1974.

In a note dated May 23, 1975 (No. 174/75-16.B.18), the Government of Uruguay requested a 90-day extension in order to transmit the information on the measures adopted by virtue of the resolution approved in October 1974.

The Commission took cognizance of this request at its thirty-fifth period of session (May 1975) and decided to grant the Government of Uruguay an extension of only 30 days for transmittal of the appropriate information. The Government in question was informed of this decision through a note dated June 12, 1975.

In a note of June 12, 1975 (no.234/75), the Government of Uruguay, within the required period of time, replied as follows.

In accordance with instructions received from my Government, I have the honor to address your Excellency with regard to the note sent by that Commission on December 17, 1974 (Ref: CASE 1842) to the Minister of Foreign Affairs of Uruguay, through which the Commission transmitted the text of the resolution approved at the 424th meeting, held on October 23, 1974, in order to inform you of the following:

"The activities in connection with the status of Dr. Francisco W. Pucci are under the jurisdiction of the Military Supreme Tribunal, under case No. 165/74 (Lo.1Fo. 341), and are atpresent under study by the Ministers of that Supreme Military Tribunal."

The Secretariat acknowledged receipt to the Government of Uruguay on July 16, 1975, and through a letter of July 24, 1975, the pertinent parts of that information were transmitted to the claimant.

During its thirty-sixth session (October 1975), the Commission continued its examination of the case and the information provided by the Government of Uruguay, and decided to postpone its examination until the next session, once the claimant had provided the additional data requested of him.
