Communication 1804 (Guatemala)
1804, presented through a communication of March 7, 1974, requests the CIDH to intervene to guarantee respect for the outcome of the election held in Guatemala.
In a communication dated March 18, 1974, the Secretariat acknowledged receipt to the claimants, informing them that the matter would be brought to the attention of the Commission during that session. The note also requested the claimants to provide additional information, with documents that would make possible more concrete examination of the case.
During the thirty-second session (April 1974) the Commission decided to file the communication without prejudice to reopening the examination thereof should the necessary data be provided within a reasonable period of time.
In a communication of July 31, 1974, the claimants provided additional facts on the election conducted in Guatemala on March 3, 1974.
During the thirty-fourth session (October 1974), the Commission continued its examination of case 1804 and decided to refer the file to the rapporteur of the other cases on Guatemala, Dr. Genaro R. Carrió, so that he might prepare a report on the admissibility of the denunciation.
During its thirty-fifth session (May 1975), the CIDH examined the case based on the oral report presented by the rapporteur, Dr. Carrió, so that he might prepare a report on the admissibility of the denunciation.
During its thirty-fifth session (May 1975) , the CIDH examined the case based on the oral report presented by the rapporteur, Dr. Carrió, and decided, in keeping with the report, the following: to request the Government of Guatemala to provide information on the matters denounced in the complaint, in accordance with Articles 42 and 44 of the Regulations.
Pursuant to this decision, a note was sent to the Government of Guatemala on August 7, 1975.
In a letter dated August 21, 1975, the claimant was informed of the measures taken in connection with the case.
During its thirty-sixth session (October 1975) the Commission considered the report of Dr. Genaro R. Carrió, who stated that the decision taken by the Commission during its thirty-fifth session (May 1975) should be rigorously carried out, requesting the Government of Guatemala "to provide the appropriate information on the matters referred to in point 5 of the complaint..." which referred to the closing of entities that disseminate information in print and over the radio.
In response to the recommendation made by the rapporteur, the Commission decided the following: To address a note to the Government of Guatemala, requesting that it provide information on the matters denounced in point 5 of the complaint.
Pursuant to the decision, the Commission addressed the Government of Guatemala through a note of December 1, 1975. A copy of that note was transmitted to the Guatemalan Mission to the OAS, on December 2, 1975. The claimant was informed of the decision through a letter dated January 12, 1976.
