Administrative Law at the Supreme Court: NFIB v. OSHA and the Court’s Current Approach to Reviewing Federal Government Action

In the face of a continuing global health crisis, a critical question persists: what can the U.S. government do to ameliorate the harm caused by COVID-19 and its numerous associated impacts? The Supreme Court recently weighed-in on this question in NFIB v. OSHA, a case in which the Court granted a request to stay enforcement of the Occupational Safety and Health Administration (OSHA) Emergency Temporary Standard that would require private employers of a certain size to ensure that their employees are vaccinated or comply with COVID-19 testing and masking requirements.
The Administrative Law Review’s Spring 2022 Symposium will examine the impact of this ruling on U.S. efforts to combat the pandemic, and it will explore the broader Administrative Law implications of the Court’s current approach to reviewing federal
government action.
