Party-Appointed Quantum Experts: an Empirical Study of ICSID Awards
Mr. Bergolla Álvarez will address the role of party-appointed
experts in a universe of 64 publicly available ICSID awards.
This presentation will discuss (i) the influence of common law participants on
party-appointed experts practice in ICSID arbitration; (ii) the presence of
potential biases on the part of repeat-player party-appointed experts; their
ability to achieve favorable outcomes; and (iii) the tribunals' performance in
weighing complex party-appointed expert’s testimony.
This analysis is based on the classification of law firms and
arbitrators (as common law/non-common law affiliated), party-appointed experts
(by name, firm, testimony, and fees charged), and the awards (by monetary
outcomes).
