The Initiative on Election Monitoring in the Inter-American Human Rights System

The Initiative on Election Monitoring in the Inter-American Human Rights System seeks to strengthen the standards and transparency of elections of judges and commissioners to the Inter-American Human Rights System. The Initiative advances efforts to improve the nomination and election process of commissioners and judges by supporting the work of an Independent Panel of Experts who evaluate the qualifications of candidates applying to serve as commissioners and judges in the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights. The Center for Human Rights & Humanitarian Law at American University Washington College of Law supports the work of the Independent Panel by serving as its Secretariat.

Presidió el Sistema Nacional Anticorrupción de México en el año 2018, es académica, activista, ha desempeñado cargos en el servicio público y es reconocida internacionalmente como experta en derechos humanos. A lo largo de su carrera, ha fundado varias organizaciones civiles de derechos humanos y ocupado cargos importantes. Fue directora de Freedom House México; Directora para las Américas del International Center for Transitional Justice; Asesora Especial del Secretario General de la Organización de Estados Americanos para Asuntos de la Sociedad Civil; así como Subsecretaria para los Derechos Humanos y la Democracia en la Secretaría de Relaciones Exteriores durante el gobierno del presidente Fox. Colaboradora durante seis años de la Oficina de la Alta Comisionada de Naciones Unidas para los Derechos Humanos a través del Comité de Síndicos del Fondo Voluntario para la Cooperación Técnica. Consejera de la Comisión Nacional de Derechos Humanos de 2013 a 2019. Actualmente preside la organización JTMX, un espacio de reflexión sobre las posibilidades de promover un proceso de justicia transicional para México. Asimismo, es Presidenta de Oxfam-México, así como de la Asamblea Consultiva del Consejo Nacional para Prevenir la Discriminación.

A former President of the Citizen’s Committee of the National Anticorruption System of Mexico, Mariclaire Acosta is an academic, activist, former public servant, and an internationally recognized expert on issues related to the defense and promotion of human rights. During her career, she has founded several civil society organizations and held a number of prominent posts, including Director of Freedom House–Mexico; Director for the Americas at the International Center for Transitional Justice; Special Advisor to the Secretary General of the Organization of American States on civil society affairs; and Deputy Secretary for Human Rights and Democracy at the Mexican Ministry of Foreign Affairs under President Vicente Fox. She was a member of the Board of the Voluntary Fund for Technical Cooperation of the UNHCHR from 2013 to 2018. She was a member of the Board of Advisors for the National Human Rights Commission from 2013 to 2019. She currently presides over JTMX, a newly founded think-tank to explore the possibilities for transitional justice in Mexico. She is also Chair of Oxfam-Mexico and on the Advisory Board of the National Council for the Prevention of Discrimination.

Carlos Ayala es un jurista internacional con amplia experiencia en los sistemas de protección de los derechos humanos, y profesor de derecho internacional de los derechos humanos y de derecho constitucional en cursos de grado y posgrado en diferentes universidades. Es, asimismo, vicepresidente de la Comisión Internacional de Juristas y miembro del Consejo Directivo del International Human Rights Institute (IHRI). Fue presidente y miembro de la Comisión Interamericana de Derechos Humanos y Relator sobre los Derechos de los Pueblos Indígenas de las Américas entre 1996 y 1999. También fue miembro de la Comisión Andina de Juristas desde 1992 y presidente de ésta entre 2003 y 2009. En 2005 fue designado por el Alto Comisionado de la ONU para los DDHH miembro de la Comisión Internacional de Veedores para el proceso de selección y nombramiento de la Corte Suprema de Justicia de Ecuador. También fue consultor de la ONU para el nombramiento de la Corte Suprema de Justicia en Guatemala en 2009. Es Presidente Honorario de la Asociación Venezolana de Derecho Constitucional desde 1998. Sobre sus antecedentes académicos, Carlos Ayala fue Profesor Titular de Derecho Constitucional en la Universidad Católica Andrés Bello (UCAB) y en la Universidad Central de Venezuela (UCV), entre 1983 y 2008. Es Jefe de la Cátedra de Derecho Constitucional en la UCAB desde 1992. Fue Jefe del Departamento de Derecho Público en la UCAB entre 2004 y 2016. Es profesor de Protección Internacional de los Derechos Humanos en el Postgrado en Derechos Humanos en la UCV desde 1992. También es Profesor de la Cátedra de Derechos Humanos en el pregrado de la carrera de Derecho en la Universidad Metropolitana y UCAB desde el 2005, y Profesor del Postgrado en Derecho Constitucional en la UCAB desde 2006. Es Profesor de International Human Rights Law, University of Oxford, New College desde 2011; fue Profesor de Derechos Humanos y constitucionalismo en Las Américas, Georgetown University, Escuela de Postgrado, USA en 1999 y Profesor de Protección Internacional de Derechos Humanos, American University, Washington of College of Law, Postgrado en Derechos Humanos, USA, en 1999 y desde 2004 a la actualidad. También fue Profesor de Derechos Humanos, en el Postgrado en Derecho Constitucional en la Universidad Iberoamericana de México en 2003.

Carlos Ayala is an international jurist with extensive experience in human rights protection systems, and professor of international human rights law and constitutional law for undergraduate and postgraduate courses at different universities. He is also vice president of the International Commission of Jurists and member of the Board of Directors of the International Human Rights Institute. He was president and a member of the Inter-American Commission on Human Rights and Rapporteur on the Rights of Indigenous Peoples of the Americas between 1996 and 1999. He has also been a member of the Andean Commission of Jurists since 1992 and was president of the Commission between 2003 and 2009. In 2005, Carlos Ayala was appointed by the UN High Commissioner for Human Rights as a member of the International Observers Commission for the process of selection and appointment of the Supreme Court of Justice of Ecuador (2005) and a consultant to the UN for the appointment of the Supreme Court of Justice in Guatemala (2009). He is also Honorary President of the Venezuelan Association of Constitutional Law since 1998. Per his academic background, he was a professor of Constitutional Law at the Catholic University "Andrés Bello" and professor at the Central University of Venezuela, between 1983 and 2008. He has been Head of the Chair of Constitutional Law at the UCAB since 1992. He was Head of the Department of Public Law at the UCAB between 2004 and 2016. He has been a Professor of International Protection of Human Rights at the Postgraduate in Human Rights at the UCV since 1992. He has also been a Professor of the Human Rights Program in the undergraduate degree of Law at the Metropolitan University and UCAB since 2005, and Professor of the Graduate in Constitutional Law at the UCAB since 2006. He has been a Professor of International Human Rights Law, University of Oxford, New College, since 2011. He was Professor of Human Rights and Constitutionalism in the Americas, Georgetown University, Graduate School, USA in 1999 and Professor of International Protection of Human Rights at American University, Washington of College of Law in 1999 and since 2004. He was also a Professor of Human Rights, in the Graduate Course in Constitutional Law at Universidad Iberoamericana, Mexico in 2003.

Catalina Botero Marino es abogada y experta en derecho constitucional, derecho internacional de los derechos humanos, justicia transicional y acceso a la información. Actualmente ocupa el cargo de Directora de la Cátedra UNESCO de Libertad de Expresión de la Universidad de los Andes, Colombia. La Sra. Botero Marino se licenció en derecho en la Universidad de los Andes y completó su formación con estudios de posgrado en gestión pública y derecho administrativo, derechos humanos, derecho constitucional y ciencias políticas. Anteriormente se desempeñó como Relatora Especial para la Libertad de Expresión de la Comisión Interamericana de Derechos Humanos de la OEA entre 2008 y 2014. Asimismo, ha sido Magistrada Auxiliar de la Corte Constitucional de Colombia durante distintos períodos, además de desempeñarse actualmente como conjuez de dicha corporación y del Consejo de Estado. Es socia fundadora de DeJusticia Colombia. Además, es asesora de varios organismos internacionales como la UNESCO y experta invitada a diversos proyectos académicos como el Global Freedom of Expression and Information de la Universidad de Columbia. La señora Botero también forma parte de las juntas directivas de Artículo 19, del Centro de Derechos Reproductivos, Derechos Digitales y Fedesarrollo.

Catalina Botero Marino is a lawyer and expert in constitutional law, international human rights law, transitional justice and access to information and currently holds the position of Director of the UNESCO Chair in Freedom of Expression, Universidad de Los Andes, Colombia. Catalina received her law degree from La Universidad de los Andes and went on to complete her postgraduate studies in Public Management and Administrative Law, human rights, constitutional rights and political science. She previously served as the Special Rapporteur for Freedom of Expression for the OAS Inter-American Commission on Human Rights from 2008 to 2014 as well as the Auxiliary Magistrate at the Constitutional Court of Colombia for several different periods, where she currently is deputy judge, as well as of the State’s Council. She is founding partner of DeJusticia Colombia. Also, she is advisor of several international organizations as UNESCO and invited expert to academic projects such as Global Freedom of Expression and Information from Columbia University. She is also part of the directive boards of Article 19, the Center for Reproductive Rights, Digital Rights, and Fedesarrollo.

Licenciada en Sociología por la Universidad Nacional Autónoma de México, completó los estudios de la Maestría en Estudios Latinoamericanos en la misma casa de estudios, y Maestra en Derechos Humanos y Democracia por la Facultad Latinoamericana de Ciencias Sociales sede México. Se ha desempeñado en la Comisión de Derechos Humanos del Distrito Federal, en la Suprema Corte de Justicia de la Nación como asesora de la Coordinación de Derechos Humanos y Asesoría de la Presidencia del Ministro Juan N. Silva Meza, y desde febrero de 2015 coordina el Observatorio del Sistema Interamericano de Derechos Humanos del Instituto de Investigaciones Jurídicas de la UNAM. Como un espacio de naturaleza académica, desde el Observatorio se impulsan actividades de difusión de las decisiones de los dos órganos que lo integran, de formación en el sistema regional, de vinculación y de investigación. Uno de los temas que se ha abordado desde dicho espacio es el del nombramiento nacional de candidatas y candidatos a la Comisión y Corte Interamericanas y el cumplimiento de los requisitos convencionales para dichos cargos. Sus temas de interés son los derechos humanos, de manera particular los derechos económicos, sociales, culturales y ambientales.

Magdalena Cervantes holds a degree in Sociology from the National Autonomous University of Mexico, where she also completed her Master degree in Latin American Studies. She holds a Master in Human Rights and Democracy from the Latin American Faculty of Social Sciences, Mexico. She has served in the Human rights Commission of the Federal District, in the National Supreme Court of Justice as an advisor to the Coordination of Human Rights and Advisory to the Presidency of Minister Juan N. Silva Meza. Since February 2015, she has coordinated the Observatory of the Inter-American System of Human Rights of the Institute of Legal Research of UNAM. As an academic space, the Observatory, promotes activities to disseminate the decisions of the two bodies that comprise it, provide trainings on the regional system, and research. One of the issues that has been addressed by this space is the national appointment of candidates to the Inter-American Commission and Court of Human Rights and compliance with the conventional requirements for said positions. Her subjects of interest are human rights, and in particular economic, social, cultural and environmental rights.

Juan E. Méndez es Profesor Residente de Derechos Humanos en la American University - Washington College of Law, en donde también es Director de la Iniciativa contra la Tortura, un proyecto del Centro de Derechos Humanos y Derecho Humanitario de la WCL. Fue Relator Especial de Naciones Unidas sobre Tortura y otros Tratos y Penas Crueles, Inhumanos y Degradantes entre noviembre de 2010 y el 31 de octubre de 2016. Es autor (junto con Marjory Wentworth) de "Taking A Stand: The Evolution of Human Rights" (Nueva York: Palgrave MacMillan, 2011). A principios de 2017, el profesor Méndez fue elegido Comisionado de la Comisión Internacional de Juristas, Ginebra, Suiza. En febrero de 2017, fue nombrado miembro del Comité de Selección para el nombramiento de magistrados de la Jurisdicción Especial para la Paz y de miembros de la Comisión de la Verdad constituida como parte de los Acuerdos de Paz de Colombia. Fue asesor en materia de prevención del delito del Fiscal de la Corte Penal Internacional de 2009 a 2011 y copresidente del Instituto de Derechos Humanos de la International Bar Association en 2010 y 2011. Hasta mayo de 2009 fue el presidente del International Center for Transitional Justice (ICTJ). Paralelamente a sus funciones en el ICTJ, el Honorable Kofi Annan nombró al Sr. Méndez como su Asesor Especial para la Prevención del Genocidio, tarea que desempeñó de 2004 a 2007. Ha sido profesor de Derecho Internacional de los Derechos Humanos en la Facultad de Derecho de Georgetown y en la Escuela de Estudios Internacionales Avanzados de Johns Hopkins. Además, enseña regularmente en el Programa de Maestría de Oxford en Derecho Internacional de los Derechos Humanos en el Reino Unido, donde es miembro visitante del Kellogg College. Su campo de práctica actual es el Derecho Internacional de los Derechos Humanos, con experiencia en Justicia Transicional, Prevención del Genocidio y Atrocidades Masivas, Derechos de Personas Privadas de Libertad y Derecho a la Integridad Personal. El señor Méndez es miembro del colegio de abogados de Mar del Plata y Buenos Aires, Argentina, y del Distrito de Columbia, EE. UU. Posee un título de J.D. de la Universidad Católica Stella Maris en Argentina y un certificado de la American University Washington College of Law.

Juan E. Méndez is a Professor of Human Rights Law in Residence at the American University – Washington College of Law, where he is Faculty Director of the Anti-Torture Initiative, a project to WCL’s Center for Human Rights and Humanitarian Law. He was the UN Special Rapporteur on Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment between November 2010 and October 31, 2016. He is the author (with Marjory Wentworth) of “Taking A Stand: The Evolution of Human Rights” (New York: Palgrave MacMillan, 2011). In early 2017 Professor Méndez was elected Commissioner of the International Commission of Jurists, Geneva, Switzerland. In February 2017, he was named a member of the Selection Committee to appoint magistrates of the Special Jurisdiction for Peace and members of the Truth Commission set up as part of the Colombian Peace Accords. He was an advisor on crime prevention to the Prosecutor, International Criminal Court from 2009 to 2011 and Co-Chair of the Human Rights Institute of the International Bar Association in 2010 and 2011. Until May 2009 he was the President of the International Center for Transitional Justice (ICTJ). Concurrent with his duties at ICTJ, the Honorable Kofi Annan named Mr. Méndez his Special Advisor on the Prevention of Genocide, a task he performed from 2004 to 2007. He has taught International Human Rights Law at Georgetown Law School and at the Johns Hopkins School of Advanced International Studies, and he teaches regularly at the Oxford Masters Program in International Human Rights Law in the United Kingdom, where he is a Visiting Fellow of the Kellogg College. His current field of practice is International Human Rights Law, with expertise in Transitional Justice, Prevention of Genocide and Mass Atrocities, Rights of Persons Deprived of Liberty, and the Right to Personal Integrity. Mr. Méndez is a member of the bar of Mar del Plata and Buenos Aires, Argentina, and the District of Columbia, U.S., having earned a J.D. from Stella Maris Catholic University in Argentina and a certificate from the American University Washington College of Law.

Elizabeth Salmón es doctora en Derecho Internacional por la Universidad de Sevilla y profesora principal de Derecho Internacional en la PUCP. Es directora ejecutiva del Instituto de Democracia y Derechos Humanos de la PUCP y miembro del Comité Asesor del Consejo de Derechos Humanos de las Naciones Unidas, del que fue presidenta durante el 2019. Asimismo, es jurista experta extranjera para actuar como Amicus Curiae en la Jurisdicción Especial para la Paz en Colombia. Es autora de varias publicaciones en derecho internacional público, derecho internacional de los derechos humanos, derecho penal internacional, derecho internacional humanitario y justicia transicional. Ha sido directora de la Maestría en Derechos Humanos de la PUCP, consultora en los ministerios de Justicia y Defensa del Perú, así como de la Comisión de Verdad y Reconciliación peruana, de las Naciones Unidas y del Comité Internacional de la Cruz Roja. Además, es profesora visitante y dicta cursos especializados en diversas universidades.

Elizabeth Salmón is a Professor of International Law at the Faculty of Law of the Pontifical Catholic University of Peru. She is also Executive Director of the Institute for Democracy and Human Rights of the same university. She holds a PhD in International Law from the University of Seville. She is currently a member of the United Nations Human Rights Council Advisory Committee and a Consulting Expert of the Colombian Special Jurisdiction for Peace. She has acted as a consultant to the Ministry of Justice and Ministry of Defense of Peru, the Truth and Reconciliation Commission of Peru, the United Nations and the International Committee of the Red Cross. She also participates as a speaker in numerous seminars, conferences and events around the world and she is the author of several publications in Public International Law, International Human Rights Law, International Criminal Law, International Humanitarian Law and Transitional Justice.

Judith Schönsteiner es doctora en derecho, LL.M. en Derecho Internacional de los Derechos Humanos por la Universidad de Essex, M.A. en ciencia política por la Universidad Johannes Gutenberg de Mainz. Es profesora asociada de la Facultad de Derecho de la Universidad Diego Portales, Santiago de Chile, e investigadora de su Centro de Derechos Humanos, que también dirigió entre 2012 y 2017. Se especializa en materia de derechos humanos y empresas y ha investigado sobre el sistema interamericano de derechos humanos, así como la incorporación del derecho internacional de los derechos humanos en el orden jurídico interno. Fue miembro del Panel de Expertos Independientes en 2019. Ha capacitado a funcionarios y funcionarias del Ministerio de Relaciones Exteriores de Chile, el Ministerio de Justicia del Perú, el Instituto Nacional de Derechos Humanos de Chile, y diferentes organizaciones de la sociedad civil. Es profesora del Magister de Derecho Internacional de Derechos Humanos de la UDP. Ha sido investigadora visitante del Instituto Max Planck de Derecho Público Comparado y Derecho Internacional, Heidelberg, y profesora invitada del Magister de Derechos Humanos de la Friedrich Alexander-Universität Erlangen-Nürnberg.

Judith Schönsteiner has a Ph.D. in Law, and an LL.M. in International Human Rights Law from the University of Essex. She also holds an M.A. degree in political science from the Johannes Gutenberg University of Mainz. She is an associate professor at the Diego Portales University- School of Law, Santiago de Chile, where she also works as a researcher for its Center for Human Rights, which she directed between 2012 and 2017. She specializes in business and human rights and has conducted research on the Inter-American Human Rights System, as well as on the incorporation of international human rights law into the domestic legal order. In 2019, she participated as a member of the Independent Panel of Experts. She has trained officials from the Ministry of Foreign Relations of Chile, the Ministry of Justice of Peru, the National Institute of Human Rights of Chile, and representatives from different civil society organizations. She is a professor of the Master in International Human Rights Law at the UDP. She has been visiting researcher at the Max Planck Institute for Comparative Public Law and International Law, Heidelberg, and visiting professor at the Magister of Human Rights at Friedrich Alexander-Universität Erlangen-Nürnber.
