The Third Annual Patent Administrative Law Symposium: The Patent and Trademark Agency?

Date: 03/27/14
Times: 09:00AM - 04:00PM
Description: Trademark Agency? Substantive Patent RulemakingThe passage of the Leahy-Smith America Invents Act in 2011 and its subsequent implementation highlighted the importance of patent law. The U.S. Patent and Trademark Office, despite possibly not having substantive legislative rulemaking authority, has been defining legal standards, promulgating regulations, and adjudicating patent validity disputes alarmingly fast. Likewise, the International Trade Commission continues to adjudicate billion-dollar intellectual property disputes and announces new interpretations of statutes and rules of law with every decision handed down. This conference will provide a careful analysis of the role of administrative rulemaking law, stare decisis, and adjudicative authority over patent rights.
