“Is It Recess Yet?: Congress, the President, Recess Appointments, and The NLRB v. Noel Canning"

Tuesday, April 08, 2014
12:00 PM - 2:00 PM
American University Washington College of Law
4801 Massachusetts Avenue, NW, Washington, DC
Room 603

When can the President make appointments without the advice and consent of the Senate through his recess appointment power? This debate and discussion will cover this controversy as presented in the recent NLRB v. Noel Canning case heard before the Supreme Court. It raises questions ranging from "What is a recess?" and "What does 'must arise' mean?" to "Is a pro forma session a session?" and more.
