Description

Provides an introduction to foreign legal systems of the civil law tradition in the language of origin (Spanish). The course will consider the theoretical foundations of the continental system, the main differences as compared to the U.S. framework, and the sources of continental law. Students will gain an understanding of the role and function of the constitution in countries of the continental law tradition and the hierarchical structure and different weight that written laws, judicial decisions, doctrine, principles of law, and contracts play as a source of law in this system. The course will include analysis of legal concepts of civil law as opposed to criminal law, jus in rem, personal rights, pledge, mortgage, and property and ownership, among others.
