Description

The seminar is designed to give an appreciation of the importance of foreign direct investment for regional development. It will analyze the balance of political, economic and commercial interests that exist within the various mechanisms available and an introduction to the case law that is evolving, particularly under the North American Free Trade Agreement (NAFTA). It is a comparative law seminar, so investment rules under NAFTA, the EU-Mexico FTA, MERCOSUR, the US-Chile FTA, and other agreements will be analyzed and discussed. Because of the controversy and evolving case law under NAFTA Chapter 11, much of the seminar will involve reviewing that evolving case law to illustrate the principles that apply more generally to investment accords.
