Description

This course examines litigation under Section 1983 of the Civil Rights Act of 1871 against state and local officials, as well as so-called Bivens’ actions against federal officials, alleged to have committed constitutional and statutory torts in violation of civil rights. Thousands of Section 1983 cases are brought in the federal courts each year, and this statute has recently received substantial attention from the Supreme Court. Bivens and Section 1983 litigation will be studied against the historical and conceptual background of federal and state sovereign immunity, the main stumbling blocks to suing governments directly. The course will give detailed attention to evolving Supreme Court case law respecting the Eleventh Amendment and state sovereign immunity, and will also cover related topics such as attorneys’ fees, damages and prisoners’ rights.
