Description

Public Health Law: Flu epidemics, HIV, tobacco addiction, obesity, air and water pollution, – all are considered public health problems to be addressed by public policies and law. This course will examine the history of public health law in the United States and the effort to balance individual interests in privacy and autonomy with community interests in maintaining an environment in which people can lead healthy lives. Public health law thus consists of state and federal statutes enacted within Constitutional limits; tort and contract common law; and administrative regulations. In addition, US public health law increasingly responds to the international health regulations of the World Health Organization and obligations resulting from its membership in the World Trade Organization. The primary text will be Public Health Law, Power, Duty, and Restraint by Lawrence O. Gostin, Second Edition, 2008, supplemented by particular cases, statues and materials available on-line. Students may choose to write a research paper or take an 8 hour self scheduled take home exam at the end of the term.
