Description

This course will teach lawyering skills relevant to three main areas of the practice of trademark law—trademark clearance and prosecution, trademark enforcement, and trademark litigation before the Trademark Trial and Appeal Board and the courts. The objective of this course is to offer students the opportunity to apply their knowledge of trademark law to real-world trademark issues faced by trademark practitioners. This course will follow the “life” of a trademark and the role a trademark lawyer plays in the selection, clearance, adoption, protection, and enforcement of the trademark. Students will learn best practices for reviewing trademark clearance searches and preparing written clearance opinions, prosecuting applications and maintaining registrations, enforcing rights in a trademark through cease-and-desist letter campaigns and other dispute strategies, negotiating and drafting trademark agreements, and litigating trademark cases before the TTAB and the courts. Students will be required to participate in written and verbal exercises to develop and hone practical skills in all of these areas.
