Description

In this seminar, students will interview actual clients to determine their eligibility for expungement of a criminal record. The seminar will cover four main areas: collateral consequences of a conviction, statutory analysis and application, interviewing theory and practice, and legal writing - all in order to prepare students to meet with clients in Montgomery County and assess their eligibility of expungement of their criminal records under Maryland law. The course will be interactive and intensive. The first half of the class will be spent learning Maryland's expugement statute, analyzing how it matches up with other expungement statutes adopted around the country, and practicing, through simulation, witness interviewing skills.In the second half of the course, students will meet with clients in to assess their eligibility for expungement and, when applicable, to draft petitions for expungement.

Prerequisite: Criminal Procedure. Students who have already taken a clinic or Interviewing and Counseling are not eligible to register for this course. Students will also need to be able to schedule two client interview sessions (morning-long) beginning in March. This seminar will not meet during the weeks when students are interviewing clients, thereby providing additional scheduling flexibility. Please contact Profs.
