Description

This seminar permits and encourages students to write a research paper about an intellectual property topic of their choice, with a preference for topics investigating innovative licensing solutions to problems created by law. Some of the reading will take an historical perspective and focus on moments such as the creation of collective rights organizations in Europe and the US and the rise of public licensing in software and creative works as examples of creativity by lawyers to fill gaps or correct deficiencies in the public law. We will also take a close look at the recent settlement of the litigation between Google and the Author's Guild over scanning out-of-print books. Students have the option to earn three credits by writing a longer and more in-depth research paper.
