Grading Policy: The grade will be based on a written final examination, subject to being increased or decreased one notch (e.g., from B+ to A-) based on class participation, including thoughtful preparation of occasional written assignments and quality of contributions in class.

Description

This course provides an overview of the practice of family law with a reasonably in-depth study of the substantive law relating to child custody, spousal and child support, determination of property rights and equitable distribution. The law and practice relating to Premarital Agreements and Marital Settlement Agreements are also covered. Professional dealings with the client and opposing counsel, ethical considerations, tax and other issues commonly involved in divorce cases are identified and considered throughout the course. The course will be most valuable to students who are seriously considering a professional involvement in family law.

The required text is Family Law Cases, Text and Problems (4th ed.) by Ellman, Kurtz, Scott, Weithorn, and Bix; published by Lexis Nexis.

Some reference will be made to newly approved The American Law Institute “Principles of the Law of Family Dissolution: Analysis and Recommendations.” Excerpts of the ALI Principles are in the text and full copies should be on reserve in the library.
