Description

This course will examine health care fraud and abuse laws from the perspectives of health care contracting and health care compliance. Emphasis will be placed on the federal Anti-Kickback Statute, Stark Law and False Claims Act, but state law issues will also be considered. In addition, this Course will review sanctions and governmental enforcement initiatives. Students will apply health care fraud and abuse laws to sample health care contracts. This Course will also consider the complexities and challenges that arise in developing and maintaining an effective compliance program for health care organizations. Compliance failures and headlines will be used as a teaching tool to explore these issues. Reading and class lectures will be supplemented with contract review, mock client hypotheticals and issue-spotting exercises. Students will have the opportunity to hone analytical and writing skills as they apply health care fraud and abuse laws to fact patterns. Students will learn from expert guest lecturers from both the government and private practice perspectives.
