Description

The course consists of two parts, each with a somewhat different focus. The first two-thirds of the semester will examine in detail the way the Supreme Court operates as an institution, how the Justices shape their docket and decide the cases. There will be role-playing exercises designed to promote critical thinking about the business of the Court.

The last third of the semester will explore the role of the Supreme Court in American society. The aim is to understand the different roles the Court may assume through broader and narrower approaches, through activism or more restrained decisionmaking. The focus will be a comparison of the Warren Court, Burger Court and Rehnquist Court.
