This course is taught using a textbook, rather than a casebook, with a focus this year on recent problems with the housing market and mortgage foreclosure and modification.

Description

Examines the real estate transaction and conveyancing process as it relates to land finance and mortgages, deeds of trust, the loan underwriting and appraisal process, loan commitments, the secondary market for mortgages, mortgage notes, prepayment covenants, transfer of the note and mortgage, defaults and acceleration of debt, the right to reinstate and redeem the debt, receivers and other pre-foreclosure processes and remedies, foreclosure and recent problems with this process, real estate bankruptcies, and loan workouts and modifications.
