Description

This course examines real estate finance transactions and markets: mortgage brokerage, contract of sale “subject to financing” clauses, loan policies of title insurance, mortgage escrows, recording, mortgage and deeds of trust underwriting and appraisal procedures, loan commitments, the secondary market for mortgages, alternative mortgage instruments, and mortgage substitutes, mortgage notes, prepayment covenants, transfer of the note and mortgage, defaults and acceleration of debt; the right to reinstate and redeem the debt, receivers and other pre-foreclosure remedies, foreclosure procedures and remedies; the rights of parties omitted from foreclosure, real estate bankruptcies, loan workouts, and the environmental law aspects of real estate transfer and finance. This course is co-taught with Alan Mark, WCL ‘73. There is an in class final examination.
