Description

This is the required criminal procedure course, covering search and seizure law, confessions, and identification procedures. Topics covered include: what is a “search”; what is a “seizure”; when a warrant is required; the concept of probable cause; the stop and frisk doctrine; exceptions to the warrant requirement; the exclusionary rule and its good faith exception; the Miranda doctrine; voluntariness of confessions; the right to counsel; and identification procedures. This course includes the use of problems and each class (except the first class) has a problem associated with it. Each student is required to argue for the prosecution or the defense on one of the problems during the course of the semester; however, all students in the class are expected to be familiar with each problem.
