"The Fair Use Doctrine as a Limitation to Copyrights and the Three-Step Test in a Comparative Perspective of the Brazilian and American Copyright Systems"
The Fair Use doctrine was developed within the U.S. copyright system to set limits on the exclusive right to use copyrighted work by the author, creator, or owner of a copyright. The doctrine aims to determine a balance between the conflicting interests of copyright owners and users. The "Three-Step Test" is an international standard in the field of copyright law that was set forth in the Berne Convention, TRIPS, and WIPO WCT agreements. The dissertation will evaluate the Fair Use doctrine in terms of it's conformity with the "Three-Step Test" copyright scheme. Does the Fair Use doctrine comply with the justifications for copyright protection, and with international agreements? To what degree can the doctrine be applied to the Brazilian copyright system, without conflicting with any of Brazil's international agreements or with Brazilian legislation?
