"Guidelines for the Liberalization of Cross-border Trade in Financial Services and the Standard of Prudential Discretion"

Developing countries are reluctant to liberalize cross-border trade due to the concerns about the difficulty of consumer protection and the decrease of foreign direct investments (FDI). Even developed countries restrict cross- border trade by imposing prudential measures, such as the commercial presence requirement. This paper will prove that prudential measures are subject to certain constraints in order to prevent them from being used as a trade barrier. Furthermore, this paper will provide guidelines for the liberalization of cross-border trade in financial services to address the problems of consumer protection and the decrease in FDI.
