“An Examination of Problematic Areas of International Commercial Arbitration from an International Perspective, and a Comparative Analysis of the Law and Practice of International Commercial Arbitration in Brazil”

This dissertation looks into some problem areas in international commercial arbitration. These areas include: the claim of sovereign immunity by a state party involved in a dispute; the extent of harmonisation of international commercial arbitration laws; and the role played by national courts in this international method of dispute resolution. The dissertation also considers the changing framework of Brazilian law as far as international commercial arbitration is concerned, comparing the Brazilian attitude towards international commercial arbitration with other countries in Latin America. It will present recommendations to improve the legal framework of international commercial arbitration in Brazil.
