“An Argument for the Compensability of Partial Regulatory Takings under the 5th Amendment”

This paper discusses the history of the Takings Clause jurisprudence with an eye towards regulatory takings cases. It ultimately seeks to demonstrate that jurisprudence in this area is inconsistent, and in conflict with some fundamental principles in areas of law that bear a nexus to the takings law. It proposes a new way to decide the compensability of partial regulatory taking that, while in common usage in several other fields of law, has not been previously used with regard to takings. It aims to show how this would be consistent with Madison’s intent when he wrote the 5th Amendment.
