Communication 1915 (Uruguay)

1915, of May 7, 1975, denounces the arrest of Mr. and Mrs. Nilte and Otto Radiccioni Sánchez, in Montevideo, on February 25, 1975, with no knowledge as to where they are allegedly being held.

In a note of March 17, 1975, the Commission requested the Government of Uruguay to provide the appropriate information.

A copy of that note was transmitted to the Uruguayan Mission to the OAS on March 18, 1975. In notes dated March 18 and March 25, 1975, the Commission informed the claimants of the measures taken in connection with the denunciation.

In a communication dated May 15, 1975, the claimants supplemented their denunciation by providing additional data on the conditional freedom of Professor Nilte Radiccioni and on the place and conditions of imprisonment of Mr. Otto Radiccioni.

The Commission examined this case during the course of its thirty-fifth sessions (May 1975) together with the additional information provided by the claimants; in view of the fact that the Government of Uruguay had not yet provided the appropriate information, it decided to repeat its request to the government of Uruguay for that information, transmitting to it at the same time, the pertinent parts of the additional data provided by the claimants.

Pursuant to this decision, a note sent to the Government of Uruguay on August 7, 1975. A copy of the this note was sent to the Uruguayan Mission to the OAS on August 18, 1975. On September 25, the claimants were informed of the handling of the case.

Though a note of Septembr 18, 1975 (No. 332/75), the Government of Uruguay replied to the request for information on this case:

"1) Status of Mrs. Milte Radiccioni

"The above-named individual was arrested on February 24, 1975, as a member of the illegal organization "Partido Obrero Revolucionario" linked with sedition, in which she conducted activities under the alias of 'Antonia', in the 'Montevideo' region, cell 'Magisterio'.

"She was immediately brought before the competent judicial authority, the Military Trial Judge of the Second Court, who ordered her confinement in a military unit, in application of the pertinent legal provisions.

"On May 6, 1975, the judge in question ordered the release of Mrs. Milte Radiccioni, who at present resides on Calle Emilio Raña No 3074, in Montevideo.


"2) Status of Mr. Otto Radiccioni

"The above-named individual was arrested on February 25, 1975, as a member of the illegal organization "Partido Obrero Revolucionario" linked with seditious acts, in which he carried out activities under the alias of 'Raul', at the 'Political Bureau'.

"He was immediately brought before the competent judicial authority, the Military Trial Judge of the Second Court, who ordered his confinement in a military unit, in application of the pertinent legal provisions.

"At the present the individual in question confined in the barracks of the Naval Fusiliers, where he is visted by members of his family and receives a regular check up from the health services in that Unit.


.The Secretariat acknowldeged receipt to the Government of Uruguay on September 22, 1975, and in a letter dated September 25, 1975, the pertinent parts of the information provided by the Government of Uruguay were transmitted to the claimant.

During its thirty-sixth session (October 1975) the Commission considered this communication together with the information provided by the Government of Uruguay and decided the following: To file the case as regards Mrs. Milte Radiccioni and to postpone examination of the denunciation until its next session should the claimant formulate observations.
